1. WHAT PERSONAL INFORMATION DO WE COLLECT AND HOW DO WE USE IT?

In short: The personal information we collect about you depends on how you interact with us.  This section explains the different relationships you may have with Pulse Labs, and how we use the personal information we collect in each case. 


Personal information we collect automatically when you visit our website or use our services

  • What we collect:
  • Technical Information: This includes your IP address, device type (e.g., iPhone, desktop, PC), unique device identifiers, the type of browser you are using (e.g., Chrome, Internet Explorer), network configuration data, geographic location from which you are accessing our site (country or city-level location based on your IP address).
  • Usage Information: We also collect information about how you interact with our website and services. This information includes the pages you visit and features you use, the tools you use when participating in a Project, and the website from which you came to our site. We do not collect “sensitive personal information” as the term is defined by California law beyond what is necessary to provide your requested services and so do not provide a mechanism for you to request that we limit our use of sensitive personal information.

  • Analyze and improve our offerings: We use this information for internal analysis to better understand who our visitors are, where they come from, and what content interests them the most so we can improve the quality and relevance of our websites, content, and products.
  • Operate and secure the website and services: We use this data to run, maintain, and protect our websites and services, prevent illegal or unauthorized access to our services, enforce the terms and conditions, and ensure you can access the content you requested. Securing our website and services includes investigating suspicious use, preventing fraud, and creating device fingerprints to prevent ineligible users from participating in surveys or research studies or from attempting to participate multiple times in a survey.
  • Personalize your experience: We may use this automatically collected data to determine or infer your professional interests so we can personalize our messages, send targeted advertising, recommend the most relevant solutions for your organization, and make our sales and marketing efforts more efficient.
  • Legal basis: Our legitimate business interests or your consent (if required).


Personal information we collect if you are a representative of a company that is or is exploring becoming a Pulse Labs client.

  • What we collect: Your business contact information (such as your name, email, telephone number, company name), information about the reason for the inquiry, account credentials (such as username and hashed password), billing information, and any other details you choose to provide.
  • Why we collect it: To communicate with you, fulfill your requests, manage your organization’s account (including billing), provide you with product information (including marketing emails, in accordance with your marketing preferences), and to request feedback about your use of our Services.
  • Legal basis: Our legitimate business interests or your consent (if required)

Personal information we collect when you sign up to be a panelist and when we verify your identity

  • What we collect: Your contact information (such as your name, email, telephone number), demographic information (such as age range, location, gender), and account credentials (such as username and hashed password).  We also may use identity verification and fraud prevention providers that process information such as selfie videos, government-issued ID, biometric identifiers, and device-related information. 
  • Why we collect it: 
  • Operate the website and services: To create an account that enables you to be selected for panels, to reimburse you for projects you participate in, and to communicate with you (such as about your participation in a project, new project opportunities, updates to our terms or services, and to request feedback about your use of our Services). 
  • Secure the website and services: To detect and prevent fraud, verify participant eligibility and identity, identify duplicate or unauthorized participation, and maintain the integrity and security of our services. 
  • Legal basis: Our legitimate business interests and performance of a contract and your explicit consent where required.


Profile Enhancement Using Screener Responses
To keep your Pulse Voices profile accurate and up to date, Pulse Labs may use information you provide if you complete eligibility screeners for specific client research studies and projects. These screeners may ask for information such as demographic characteristics, device ownership, product usage, professional background, interests, or other profile-related information that you choose to provide.


How We Use This Information
Pulse Labs uses this information to:

  • Enrich your profile and keep it current and accurate;
  • Better understand your qualifications and interests;
  • Improve participant matching and recruitment;
  • Invite you to future research opportunities that may be relevant to you; and
  • Improve the overall operation of our participant community and research platform.


Relationship to Client Research Projects
Clients who send out these screeners for their projects independently determine how they use screener responses and study data for their own research purposes and act as independent data controllers for that processing.

Pulse Labs' use of profile-related information in the screeners to maintain and enhance your Pulse Voices participant profile is separate from the client's use of screener responses or study data for a specific project. Pulse Labs makes its own independent decisions regarding the collection, maintenance, and use of screener information for participant management, panel administration, and future research recruitment purposes.


We only incorporate information into your Pulse Voices profile where relevant to maintaining an accurate participant record and facilitating future research opportunities.



Personal information we collect if you participate in a project

When you participate in a project, the organization running the project is the controller of any personal information collected in the Project, and Pulse Labs is the processor, processing the data on their behalf to collect it and generate results. Our handling of your personal information collected in a project is governed by our contract with that organization, not this Privacy Policy. If you have questions about how the organization running your Project uses your personal information, or if you want to exercise your data privacy rights, please contact the organization directly.


Personal information we collect if you are or are exploring becoming a Pulse Labs agent.

  • What we collect: Your business contact information (such as your name, email, telephone number, company name), account credentials (such as username and hashed password), billing information, and any other details you choose to provide.
  • Why we collect it: To respond to your inquiries about becoming an agent, communicate with you, fulfill your requests, manage your account (including billing), provide you with Service updates (including marketing emails, in accordance with your marketing preferences), and to request feedback about your use of our Services.
  • Legal basis: Our legitimate business interests or your consent (if required).


Personal information we collect if you apply for a job 

  • What we collect: Your name, email address, your resume cover letter, reference checks and background checks. 
  • Why we collect it: To assess your qualifications for the position, including communicating with you about your application, conducting interviews and evaluations, performing background or reference checks (with your consent), and complying with applicable legal and regulatory obligations. We may use your personal information to reach out to you about future roles, unless you tell us not to.
  • Legal basis: Our legitimate business interests, meeting our legal requirements, and consent where required.


Personal information you provide to us 

  • What we collect: You may provide us with contact information (such as your name, email, telephone number, company name) when you send us questions through our website, or sign up to participate in contests.
  • Why we collect it: To communicate with you, fulfill your requests, manage contests, or award prizes.
  • Legal basis: Our legitimate business interests or your consent (if required).

2. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In short: We may share or make your personal information accessible to third parties in the situations described below.


With participants in the Pulse Labs platform

When you register on the Pulse Labs site as a panelist, you create a profile that will be visible to Pulse Labs, clients and agents to invite you to Projects.  Your user name (which defaults to your first name and last initial), and any demographic and other data you have provided in response to screening questions will be visible. Please remember any additional personal information you choose to share directly with agents and clients is outside Pulse Labs’ control.


When you register as an agent, your profile will be visible to clients, and to other agencies if you choose. When you register as a client, your profile is visible to agencies.


Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors or agents who perform services for us on our behalf and require access to such information to do that work. They are contractually obligated to use the personal information only to provide these services. Examples include: payment processing, data and site usage analysis (for example to help us determine the popularity of certain content and better understand use of our services), fraud and quality validation, email delivery, hosting services, customer service and marketing efforts.

Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

Advertising. When you visit our website, we may enable third parties to use cookies and other trackers to show you ads on third-party websites that are more relevant to you. Under some data protection laws, our disclosure of this information to third parties through cookies and other trackers for targeted advertising may be considered a “sale” or “share” of personal information. Our servers are located in the United States and we may transfer the personal data we collect about you to the United States of America or other countries for the reasons set forth in this policy.

5. HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?

In short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We keep your personal information only for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

6. DO WE COLLECT PERSONAL INFORMATION FROM MINORS?

In short: We do not knowingly collect data from or market to children under 18 years of age without parental consent.

We use appropriate technical and organizational measures to protect your personal information. However, no one can guarantee the security of information transmitted through the internet. You are responsible for maintaining the security of your password or other forms of authentication involved in accessing password-protected or secured resources.

8. WHAT ARE YOUR PRIVACY RIGHTS?

In short: Depending on where you are located and how you interact with us, you may have certain rights over the personal information we hold about you. You also have the ability to update personal information in your account and to terminate your account. 


Understanding your data subject rights
Under certain data protection laws you may have the right to (i) request access and obtain a copy of your personal information, (ii) correct inaccurate personal information or request deletion of your personal information, (iii) restrict the processing of your personal information, (iv) request portability of your personal information, (v) object to the processing of your personal information in cases where we are doing so on the basis of our legitimate interests in the EEA, UK, and Switzerland, (vi) opt out of the sale or sharing of personal information for targeted advertising, (vii) opt out of marketing communications we send, which includes the profiling we conduct to support such marketing, (viii) request information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year, and (ix) withdraw your consent at any time, if we are relying on your consent to process your personal information. Please note we may still need to send you service-related emails related to administration and use of your account.
